Commission considers sewer right of way, trail project resolutions at meeting

At its first meeting in April, the Shelby County Commission considered multiple bids and resolutions regarding upcoming projects.

At its April 9 meeting, the commission awarded a bid for an upcoming trail project at Cahaba River Park, which County Manager Alex Dudchock said included 10 miles of additional multi-use trails for runners, mountain bikers and hikers, as well as a trailhead facility.

“We’re excited,” Dudchock said.

The bid was awarded to TrailVisions LLC in the amount of $195,555.21. This project will be part of the Alabama Department of Economic and Community Affairs Recreational Trails Program.

The commission also approved a resolution pertaining right-of-way agreements with one of the sewer systems within the county.

Double Oak Water Reclamation, which serves around 4,076 sewer accounts in Shelby County, plans to sell its assets to a new entity called Shelby Ridge Utility Systems. According to the resolution, Shelby Ridge will take over right-of-way agreements between Double Oak and the county.

The county attorney and engineer looked at and made final adjustments to the resolution, Dudchock told the commission, prior to the resolution coming before the commission.

According to the resolution, DOWR has entered into a purchase agreement “to sell substantially all of its assets to Shelby Ridge Utility Systems, LLC” and as part of that agreement, DOWR would assign all right-of-way agreements to Shelby Ridge.

Upon the sale, Shelby Ridge will comply with terms and provisions of the county resolution from November 2000 regarding location of utilities on county rights-of-way and a 1998 agreement regarding rights-of-way specific to the DOWR system, according to the resolution passed today. Some of the terms include getting approval from the county engineer prior to installing sewer facilities; assuming the cost of relocation, adjustment, repair or removal of facilities in county rights-of-way; operating and maintaining facilities in accordance with county rules, regulations and requirements; and other terms.

The resolution also specified that there would be a surety performance bond in the amount of $500,000, which will be increased by 25 percent every five years “guaranteeing the performance by SRUS of its contractual obligations” which have been detailed in other resolutions.

The commission unanimously approved the resolution.
